RULES AND REGULATIONS 


THE FOLLOWING CONTEST IS OPEN ONLY TO RESIDENTS OF THE 50 UNITED STATES AND D.C., AGE 19 YEARS OF AGE OR OLDER. VOID ELSEWHERE, INCLUDING BUT NOT LIMITED TO ALL OTHER U.S. TERRITORIES AND POSSESSIONS AND WHEREVER PROHIBITED. DO NOT ENTER THIS CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF AND CURRENTLY RESIDING IN THE 50 UNITED STATES OR D.C. THIS CONTEST WILL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.

“The 2006 DYMO® Search for Order Opposites” Contest

OFFICIAL RULES

NO PURCHASE NECESSARY.


1. HOW TO PLAY 

Contest begins July 24, 2006 at 12:00:00 A.M. Central Daylight Time and ends October 1, 2006 at 11:59:59 P.M. Central Daylight Time (the “Promotion Period”). All entries must be received by 11:59:59 PM Central Daylight Time on October 1, 2006.

To participate in the Contest, (a) write an original essay of no more than 100 words (in English) describing why you are a Type O or Type O-No! Individual. A Type O Individual is someone who embraces organization and makes it an art-form. A Type O-No! Individual is someone who needs a little to a lot of help in the organization department. (b) Photograph a space in your home that demonstrates why you are a Type O or Type O-No! Individual. (Note: essay and photograph must be submitted together and be for entry in the same category).

To enter the Contest, visit www.dymo.com during the Promotion Period. Complete the online Contest entry form with all required information. Follow online instructions to submit entry form, original essay (type your name and the category for which you are submitting your entry at the top of the essay...such information does not count toward the 100 word limit), and one (1) uploaded photograph (must use either a JPEG or GIF electronic format that does not exceed 1.5 MB in size). Limit one (1) entry per person. Entries and photographs become the sole property of DYMO (“Sponsor”) and will not be acknowledged or returned. Proof of submission is not proof of receipt by Sponsor. Sponsor reserves the right to void all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such method.

2. ELIGIBILITY 

Contest is open to those 19 years of age or older at the time of entry who are legal residents of the 50 United States or D.C. Employees of DYMO, its parent company, affiliates, subsidiaries, advertising and promotion agencies, and members of the immediate families or households of any of the above, are NOT eligible to participate. "Immediate family" means parents, sisters, brothers, children, husband and wife. You must have internet access and a camera prior to the start date of the Sweepstakes.

3. CONDITIONS OF ENTRY 

All entry materials must be in English, and essay may not exceed the 100 word limit. Entry materials may not contain any third party trademarks, copyrighted materials, or identities of individuals other than the entrant . Photograph must be of a space that entrant is responsible for cleaning/organizing (you may not submit a photograph of another person’s space). If entrant is not the photographer, entrant must have permission from the photographer to enter the photograph in the Contest and for Sponsor to use the photograph online and as otherwise authorized in these rules. If any of the winning entries photographs’ were taken by a third party, as a condition of winner receiving his/her prize, photographer will have to assign all rights and interests in and to the photograph to Sponsor for no additional compensation. The entrant is the individual whose name and address appear on the entry form. Only one (1) entrant’s name may appear on the entry form. In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The “authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry must be entrant’s own original creation, executed solely by entrant, and may not have won any other award or have been entered in any other competition. Entries may not have been published previously. Modifying, enhancing or altering a third party’s preexisting work does not qualify as entrant’s original creation. Entry must be in keeping with Sponsor’s image and may not be offensive, as determined by Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or dead, or otherwise infringe upon any person’s personal or proprietary rights, including but not limited to intellectual property rights. The right to submit or use the entry shall not be restricted. Any entrant whose work includes references to third parties or contains elements not owned by entrant (such as, but not limited to, company names or trademarks) may be disqualified. Entries not complying in any way with these Official Rules are subject to disqualification. No correspondence regarding entries will be entered into with entrants except as provided herein. Submission of an entry grants Sponsor the right to use, publish, adapt, assign, sell, license, edit, dispose of, and/or modify such entry (including essay and/or photograph) in any way, in commerce and in any and all media worldwide, without limitation or compensation to the entrant. Entrant may be required to sign a release to that effect. Submission of an entry constitutes entrant’s consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry, including but not limited to all intellectual property rights. Entries and photographs that are incomplete or that do not comply with these Official Rules are subject to disqualification in Sponsor’s sole discretion.



4. JUDGING 

All eligible entries received will first be judged by an independent judging organization on or about October 11, 2006 within the category for which they were submitted (either Typo O or Type O-No!) to determine 10 Finalists in each category (i.e., those entrants receiving the ten top scores in each category). If a category is not specified by the entrant at the top of his/her essay, the entry will be disqualified. Type O entrants will be judged based on the following criteria (with weight given to each criteria as noted parenthetically): (a) ability of photograph to convey Type O style (25%); (b) overall creativeness of essay (25%); (c) innovation of organizational skills as demonstrated in essay and photograph (25%); (d) helpfulness of essay and photograph to those needing organizational help (25%). The Type O-No! entrants will be judged based on the following criteria (with weight given to each criteria as noted parenthetically): (a) ability of photograph to convey Type O-No! style (25%); (b) overall creativeness of essay (25%); (c) humor of essay and photograph (25%); (d) need for organizational help as demonstrated by essay and photograph (25%).

The ten Finalists’ entries from each category will again be judged according to the criteria listed above by qualified judges who were not involved in the first round of judging. In the event of a tie, the tie will be resolved in the same manner as described above. The Finalist who submits the top scoring entry in each category shall be awarded a Grand Prize. The remaining 9 Finalists in each category will be awarded a Finalist Prize..

In the event of a tie in any round, the entries involved will be re-judged by a different judge who will serve as the tiebreaker

In Sponsor’s sole discretion, any and all entries, in whole or in part, may be posted by Sponsor at dymo.com at any time during the Contest for consumer viewing and voting; however, such voting is solely for entertainment purposes and will not effect judges’ decisions or the outcome of the Contest.

Winners will be posted on-line on or around October 18, 2006.

5. PRIZE NOTIFICATION/WINNER VERIFICATION 

Winners will be notified by phone, mail or e-mail and each Winner will be required to execute and return an affidavit of eligibility and a liability release and, except where prohibited by law, a publicity release within seven (7) days of date printed on prize notification, or prize will be forfeited and an alternate winner selected from all eligible entries received, time permitting. By accepting the prize, each Prize Winner consents to the use of his/her name, photograph and/or likeness for advertising/publicity purposes in commerce and in any and all media worldwide without limitation or additional compensation, except where prohibited by law. Prizes are non-transferable. No prize substitution or cash equivalent allowed except by the Sponsor who reserves right to award a prize of equal or greater value should a featured prize become unavailable. Except as specified, all taxes on prizes are the sole responsibility of the Prize Winner. Limit one prize per household. If prize or notification letter is returned as undeliverable or appropriate affidavits and releases are not received within the prescribed period, the corresponding prize will be forfeited and awarded to an alternate winner. In the event that the unclaimed prize is the Grand Prize, the alternate winner shall be the next highest ranking Finalist within the same category as the forfeited Grand Prize winner. In the event that the unclaimed prize is a Finalist prize, the alternate winner shall be the entrant with the highest ranking score within the same category as the forfeited Finalist that did not make it to the Finalist level. All prizes claimed will be awarded.

6. PRIZES/APPROXIMATE RETAIL VALUES ("ARV"): 

One (1) Grand Prize for Top Judged Type-O Individual: A DYMO and Newell Rubbermaid organization package, including a DYMO Personal Labelmaker, and $500 cash to be used toward cleaning services. The package includes organization solutions for your bedroom closet, garage and kitchen. (Approximate Retail Value (“ARV”): $5,000.00.

One (1) Grand Prize for Top Judged Type-O No! Individual: A DYMO and Newell Rubbermaid organization package, including a DYMO Personal Labelmaker, and $500 cash to be used toward cleaning services. The package includes organization solutions for your bedroom closet, garage and kitchen.. (ARV: $5,000.00.)

Nine( 9) Finalist Prizes for Type O Individuals: Each Finalist (excluding the Grand Prize Winner) will receive a DYMO Personal Labelmaker and a year supply of labels. (ARV: $100.00 each).

Nine (9) Finalist Prizes for Type O-No! Individuals: Each Finalist (excluding the Grand Prize Winner) will receive a DYMO Personal Labelmaker and a year supply of labels. (ARV: $100.00 each).

Total ARV of all prizes: $11,800.00.

By accepting Prize, each Prize Winner agrees to release Sponsor and its parent company, affiliates, subsidiaries, advertising and promotion agencies, and each of their respective directors, officers, employees, and agents, from any and all liability, loss or damage of any kind incurred with respect to participation in this promotion, the awarding, receipt, possession, and/or use or misuse of any prize, or participation in prize-related activities.

7. COMPLIANCE WITH RULES 

By entering, entrant acknowledges compliance with these Official Rules, including all eligibility requirements and agrees to release Sponsor and their respective parent companies, affiliates, subsidiaries, divisions, advertising and promotion agencies, and all of their respective employees, directors, officers, shareholders, agents, successors or assigns (collectively “Releasees”), from any claims, losses, actions, or damages, whether actual, incidental or consequential, arising out of or relating to entrants’ participation in this Contest, or the acceptance, possession or use/misuse of any prize, or participation in prize-related activities. Releasees are not responsible for: (i) electronic transmissions/entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, or not received by the Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed or unavailable hardware, network, software or telephone, cable or satellite transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest, (iv) any entries submitted in a manner that is not expressly allowed under these Official Rules, or (v) printing errors in these Official Rules or in any advertisements or correspondence in connection with this Contest. All incomplete or non-conforming entries will be disqualified. Sponsor is further not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the transmission, receipt or processing of the entries. If for any reason this Contest is not capable of running as planned, or if this Contest or any Web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries per these Official Rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Contest. In the event this Contest is cancelled, Sponsor reserves the right to award prizes in a random drawing from among all eligible, non-suspect, entries received prior to the time of the action or event warranting such cancellation.

8. CAUTION 

ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO DISQUALIFY ANY SUCH PERSON AND SEEK DAMAGES FROM HIM/HER TO THE FULLEST EXTENT PERMITTED BY LAW.

9. PRIZE WINNERS RETRIEVAL LIST 

For the names of the Prize Winners, mail a self-addressed, stamped envelope to: “The 2006 DYMO Search for Order Opposites” Contest Winner Request, 44 Commerce Road, Stamford, CT, 06902-4561 no later than 12/30/06.
